Agreeing to these terms

These terms are an agreement between you and Obhox LLC, which operates EvyOS (“EvyOS”, “we”, “us”). They cover the EvyOS app at app.evyos.com, the website at evyos.com and the free tools and games on it, and the EvyOS connector for AI assistants (together, “the service”).

By using the service you agree to these terms. If you do not agree, do not use it. Our privacy policy explains how we handle personal information.

Who can use EvyOS

You must be at least 13, and old enough where you live to agree to these terms. If you use EvyOS for an organisation, you confirm that you are allowed to accept these terms on its behalf.

Your account

  • Keep your sign-in details secure. You are responsible for what happens under your account.
  • Give accurate information, and keep your email address current, since that is how we reach you.
  • If you think someone else has access to your account, tell us at hello@evyos.com.

Your content

You own what you put into EvyOS: your goals, tasks, notes and everything else you create (“your content”). You give us permission to store, copy, process and display your content only as needed to run the service for you, including showing it to the people you share it with and passing it to AI assistants you connect. That permission ends when your content is deleted, apart from copies kept in backups for a short time.

You are responsible for your content and confirm that you have the right to use it. We do not use your content to train AI models.

The templates we provide are starting points for you to change as you like. They are not professional advice.

Sharing and workspaces

  • Anyone with a public note link can read that note until you turn sharing off.
  • Members of a workspace can see what is in it, and change it if their role allows. The owner of a workspace decides who is in it, and is responsible for inviting only people who should have access.
  • An invite link can be used by anyone who has it until it expires after 7 days.
  • Shared timers and game rooms can be seen by anyone with the room code.

AI assistants

On a paid plan you can connect EvyOS to an AI assistant such as ChatGPT or Claude. When you do:

  • You allow that assistant to read your records, and to create, change and delete them if you grant it write access.
  • Changes the assistant makes are made on your behalf, and you are responsible for them. AI assistants make mistakes, so check what they do.
  • Your use of the assistant is governed by its provider’s terms and privacy policy, not ours.
  • You can disconnect at any time in Settings. A connection stops working if your plan ends, and we may disconnect one that is being misused.

Acceptable use

Do not use the service to:

  • Break the law, or help anyone else to
  • Store or share content that infringes anyone’s rights, or that is abusive or hateful, exploits anyone, or promotes violence
  • Harass other people, including through invites, shared links, display names or game answers
  • Upload malware, or try to get into accounts, data or systems you are not allowed to access
  • Overload the service, get around its plan or rate limits, or collect data from it by automated means other than our API and connector
  • Copy, resell or reverse engineer the service, except where the law allows it

We may remove content or limit access to stop a breach of this section.

Plans, billing and cancellation

  • Free. The free plan costs nothing and has the limits shown on the pricing page.
  • Paid plans. Pro and Workspace Pro are billed in advance, monthly or yearly, through Clerk Billing and Stripe. Workspace Pro includes 5 members, and each member above 5 is billed as an extra seat. Prices are shown before you pay, and taxes may apply.
  • Renewal. A subscription renews automatically at the end of each period until you cancel it.
  • Cancelling. You can cancel at any time from your account. You keep your paid features until the end of the period you have paid for, and you are not charged again.
  • Refunds. Payments are non-refundable, except where the law requires a refund.
  • Price changes. We will tell you before a new price applies to you, and it takes effect from your next billing period.
  • Moving to the free plan. Nothing you created is deleted, but you cannot add more than the free limits allow, and paid features such as AI assistant connections stop working.

Changes to the service

We keep improving EvyOS, and may add, change or remove features. If we remove something significant that you pay for, we will tell you in advance. We work to keep EvyOS available, but it may be interrupted for maintenance or for reasons outside our control, and we do not promise that it will always be available or free of errors.

Ending your use

You can stop using EvyOS at any time, and ask us to delete your account by emailing hello@evyos.com. Export anything you want to keep first.

We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect the service or other people. Where we reasonably can, we will tell you first and give you the chance to export your content. If we stop offering EvyOS altogether, we will give you at least 30 days’ notice.

Disclaimers

The service is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

EvyOS helps you organise your plans. Templates and suggestions about health, money, study, work or anything else are general information, not medical, financial, legal or other professional advice.

Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim arose and US$100.

Some places do not allow these limits, so they may not all apply to you. Nothing in these terms limits liability that the law does not allow to be limited.

Responsibility for claims

If someone brings a claim against us because of your content or your breach of these terms, you agree to cover the reasonable costs of that claim, to the extent the law allows.

Governing law and disputes

These terms are governed by the laws of the United States, without regard to conflict of law rules. Before bringing a claim, please contact us at hello@evyos.com so we can try to settle it informally. If the law where you live gives you the right to bring a claim in your local courts, or the protection of local consumer law, these terms do not take that away.

Changes to these terms

We may update these terms. We will change the date at the top, and for significant changes tell you by email or in the app at least 14 days before they take effect. If you keep using EvyOS after that, you accept the new terms. If you do not accept them, you can stop using EvyOS and ask us to delete your account.

General

  • If part of these terms cannot be enforced, the rest still applies.
  • If we do not enforce a term straight away, we have not given up the right to enforce it.
  • You may not transfer these terms to anyone else without our agreement. We may transfer them as part of a sale or transfer of EvyOS.
  • These terms and the privacy policy are the whole agreement between you and us about the service.
